Businessman Boby Chemmanur Moves Kerala High Court Seeking Bail In Sexual Harassment Case
Businessman Boby Chemmanur has moved an appeal before the Kerala High Court, seeking bail in a sexual harassment complaint raised by a prominent Malayalam film actress.
Boby was denied bail by the Ernakulam Magistrate Court on Thursday (9th January) and remanded to 14 days judicial custody.
He is booked under Section 75 (Sexual Harassment) of the Bharatiya Nyaya Sanhita and Section 67 (publishing or transmission of obscene material in electronic form) of the Information Technology Act on allegation of sexually harassing the complainant during inauguration of one of his jewellery stores at Kannur.
The complainant said that this was followed by other sexually coloured remarks on YouTube and other social media platforms.
Boby claims that he is innocent and even if the allegations are accepted at face value, it does not constitute an offence.
The Magistrate Court however found prima facie case against Boby, noting that he had made physical contact and advances at the informant without her consent and indeed made remarks that were prima facie sexually coloured.
