The Jharkhand High Court has issued a directive to the state government, demanding a detailed affidavit regarding the implementation of the Ayushman Scheme across hospitals in the state.

The order follows a writ petition filed by one Ashok Kumar Mishra seeking the release of pending amounts under the Ayushman Scheme for all empanelled hospitals in Jharkhand, along with an inquiry into delays in reimbursement.

The division bench comprising Justices Sujit Narayan Prasad and Arun Kumar Rai opined, “This Court after having heard the learned counsel for the petitioner is of the view that releasing the amount in favour of the hospitals who have imparted treatment to the persons coming under the Ayushman Scheme is one of the aspect of the matter which is looking to but the measure aspect of the matter which required to look into is that as to whether one or the other hospitals which have been registered under the Ayushman Scheme are actually claiming the said amount by giving actual treatment to the patients who are coming under the Ayushman Scheme.”

“This Court, therefore, is of the view that the response from the State of Jharkhand is required to be called upon on the aforesaid issue,” the bench added.

The counsel appearing for the State has been, thus, directed to file a comprehensive counter affidavit by conducting an inquiry of the hospitals across the State which have been enlisted under the Ayushman Scheme regarding the benefits of the Scheme to ascertain the actual treatment provided or not to one or other eligible.

The matter has been posted on 22nd April 2024 for further hearing.
