The Supreme Court Collegium led by Chief Justice Dhananjaya Y Chandrachud and comprising Justices Sanjiv Khanna and B R Gavai has recommended the appointment of two Additional Judges as permanent Judges of the High Court of Jammu & Kashmir and Ladakh.
The resolution recommending the elevation of Justice Moksha Khajuria Kazmi and Justice Rahul Bharti, both serving as Additional Judges in the High Court of Jammu & Kashmir and Ladakh was made after the collegium evaluated their respective recommendations.
Justice Rahul Bharti's nomination followed a unanimous recommendation by the Collegium of the High Court of Jammu & Kashmir and Ladakh on August 21, 2023. The Supreme Court Collegium, following established procedures, consulted judges well-versed in the affairs of the High Court and assessed the quality of Justice Rahul Bharti's judgments, which were deemed "good" and "fairly reasonable" by the evaluating Committee.
Similarly, Justice Moksha Khajuria Kazmi's nomination comes after the Chief Justice of the High Court of Jammu & Kashmir and Ladakh proposed her appointment as a permanent Judge on November 18, 2023. A Committee of two judges of the Supreme court had rated the quality of her judgments as "good" and "reasonably well written."
After scrutinizing and evaluating the material placed on record for both nominees, the Collegium expressed its considered view that both Ms Justice Moksha Khajuria Kazmi and Shri Justice Rahul Bharti were eminently suitable for appointment as permanent Judges of the High Court of Jammu & Kashmir and Ladakh.
