The Jammu and Kashmir High Court has voiced its serious anguish and concern about the developments which took place on the court premises wherein a petitioner girl was forced out of the corridors of the court against her wishes by a civilian, who was said to be her brother.
The petitioner and her husband had approached the J&K High Court seeking protection after marrying against their families' wishes.
Justice Rahul Bharti said this incident exposes a lack of appropriate security measures including deficient CCTV installation on the court premises so as to ensure that each and every nook and corner gets under CCTV surveillance.
The Registrar Judicial was directed to audit the CCTV system and report deficiencies in security measures at the court premises.
The court said that the question with respect to the age of the petitioner was yet to be determined considering the fact that the Headmaster, of Government High School has certified the recorded date of birth of the petitioner to be the 6th of March, 2009, making her a minor.
The court held that she should be placed in the Child Welfare Committee Shelter Home, Sanat Nagar, Srinagar, for protection, wherein only her parents will be allowed visitation.
The court also granted interim protection from the arrest to petitioner no. 2 with whom petitioner no. 1 had approached the High Court for their protection. The court stayed the arrest until further orders.
