The Gujarat High Court recently ordered "status quo" on the alleged illegal construction of a temple on the land of Shardanagar Cooperative Housing Society in Ahmedabad's Paldi area.
A single bench of Justice Sangeeta Vishen while issuing notices to the Ahmedabad Municipal Council (AMC) and other authorities directed, “Till the next date of hearing, the parties are directed to maintain status quo". The matter is next listed on August 29.
Appearing for the petitioner society, senior advocate GM Joshi said that the private respondents had purchased the super-structure and they claim not to be the members of the society. It was submitted that a suit was filed by the respondents before the Board of Nominees which, had been rejected on the ground that the respondents were not members of the society.
It was submitted that even the municipal corporation had issued notice to the private respondents requiring to remove the illegal construction and/or to stop the same, as it was without any permission. Despite this, the construction of the temple is going on in full force, the petitioner contended.
The counsel emphasized that the land belongs to the residential society, and only its members hold ownership of the superstructures, while the non-member tenants do not have official plots.
