The Delhi High Court recently sought status report from the Medical Superintendent of Tihar Jail regarding the present medical condition of all convicts and under-trial prisoners aged above 75 years.

A division bench of Justice Siddharth Mridul and Justice Mini Pushkarna said that the status report must also include the complete details of treatments, if any, being provided to the prisoners.

The status report has to be submitted on or before May 29.

”The concerned Medical Superintendent is directed to furnish a fresh status report regarding the current medical condition of all the convicts and under-trial prisoners, who are above the age of 75 years (currently lodged in jail), including complete details of the treatments, if any, being provided to them, on or before the next date of hearing,” the bench said in an order passed on May 04.

The bench was hearing a suo motu case registered in 2005 on the the basis of a news item published in the Delhi Age titled "92 -year-old is Tihar undertrial.”

Maya Devi, the elderly lady, was involved in a case registered under Sections 419, 420, 467, 471 and 120 of Indian Penal Code. She was granted bail by the court in 2005 considering her old age as well as the report submitted by the Medical Officer of Tihar Jail stating that she was suffering from various diseases.

The court has since then been supervising the status of medical condition of the elderly prisoners in Tihar jail.
