The Delhi High Court on Friday issued notice on a plea moved by MLA Kartar Singh Tanwar against his disqualification from Delhi Legislative Assembly by the Speaker.

Justice Sanjeev Narula sought response of the office of the Legislative Assembly's Speaker as well as MLA Dilip Kumar Pandey who filed the disqualification petition against Tanwar.

Tanwar contested the General Elections to the Delhi Legislative Assembly held on February 08, 2020, in the symbol of the Aam Aadmi Party. However, he later joined the BJP. He was disqualified by the Speaker on September 24 under the anti-defection law.

Tanwar's plea states that he responded to Pandey's disqualified petition on September 03 and denied all the allegations levelled upon him by calling them “false, incorrect and farther from truth.”

The petition states that while Kartar was directed to appear in person on September 20 in Speaker's office, he wrote a letter requesting adjournment of the matter on grounds of ill health and hospitalization.

It further adds that the Speaker failed to consider his request and directed him to appear on September 24 on which day the impugned order was passed disqualifying Kartar.

The impugned Order is passed in haste without affording an opportunity of personal hearing to the Petitioner. Besides, the impugned Order is cryptic and non-speaking in nature,” the plea states.

Senior Advocate Jayant Mehta appeared for Tanwar. The plea has been filed through Advocates Neeraj and Satya Ranjan Swain.

The matter will now be heard on December 09.
