Consider Announcing AIBE Schedule Or Time Table In Advance Every Year: Delhi High Court To BCI

The Delhi High Court has directed the Bar Council of India to consider announcing a pre-set schedule or time table for conduct of All India Bar Examination (AIBE) in advance every year.

Justice Prathiba M Singh observed that a pre-set schedule or an annual time table as part of the calendar every year would go a long way in assisting the candidates and to make requisite arrangements.

“The BCI shall consider announcing in advance, every calendar year the months in which the AIBE is likely to be conducted. This is considering the fact that there are a large number of prospective candidates who have to appear in AIBE, may have to make arrangements to be physically present to be able to give the AIBE examination,” the court said.

Justice Singh disposed of a plea moved by a lawyer Nishant Khatri who got enrolled with Bar Council of Delhi on 19 November, 2019. It was his plea that he ought not be debarred from practicing in courts due to non conduct of AIBE examination.

The court had earlier directed BCI to submit a status report on having a pre-set schedule for the AIBE exam.

The counsel appearing for BCI submitted that announcing a pre-set schedule may be difficult as various stakeholders from across the country have to be consulted before the dates for the exam are fixed.

It was also submitted that tentatively the next AIBE exam is going to be scheduled in the month of September this year.

Considering the delay in conduct of the examination, Justice Singh had earlier clarified that the petitioner-lawyer would not be debarred or disqualified from continuing to rely upon his provisional registration and appearing before the courts till further orders.
