The Bombay High Court has disposed of a Public Interest Litigation (PIL) seeking the enactment of State Rules under the Rights of Persons with Disabilities Act, 2016.

The PIL filed by Yash Charitable Trust sought a direction to the State government to bring Rules under the 2016 Act in order to implement the provisions of the Act.

Today during the hearing, the State counsel submitted that the Maharashtra State Rights Of Persons With Disability Rules, 2024, were framed by the State government by exercising power under Section 101 of the 2016 Act. Section 101 empowers the State Government to make Rules for carrying out the provisions of this Act, not later than six months from the date of commencement of the Act.

The State counsel stated that the said rules were published on 05 September 2024.

A division bench of Chief Justice Alok Aradhe and Justice MS Karnik took note of the submission made by the State counsel.

In view of the submission, the Court disposed of the petition.
