The Bombay High Court on Tuesday sought intervention of Advocate General of Maharashtra Dr. Birendra Saraf to ensure that necessary infrastructure is available to implement the e-filing system effectively.
Justice MS Karnik observed that providing laptops to prosecutors is essential for effective implementation of e-filing mechanism.
“To make the mechanism of E-fling efective, it is absolutely essential that learned APPs are provided with the facility of laptops/Ipads at the earliest…Learned Advocate General is requested to look into the matter and bring this to the notice of the concerned department of the State Government for facilitating the required infrastructure for this purpose”, the court stated.
The court was dealing with a bail application which the counsel for the applicant has filed through the e-filing mechanism.
During the proceedings, APP PH Gaikwad informed the court that the hard copy of the application had just been served, and requested additional time to review the case.
The court inquired whether Gaikwad had access to a laptop or iPad to handle such electronic filings. Gaikwad informed the court that laptops have not currently been supplied to the prosecutors.
The court emphasized the necessity of providing laptops or iPads to the APPs at the earliest to ensure the efficient operation of the e-filing system.
The court urged the Advocate General to look into the matter and bring it to the attention of the relevant department of the State Government to facilitate the necessary infrastructure for this purpose.
The court adjourned the matter to December 12, 2023 after APP Gaikwad sought time to take instructions.
