The Allahabad High Court has directed the Uttar Pradesh Director General of Police (DGP) to constitute a Special Investigation Team (SIT) to probe into an MBA student's false implication and arrest concerning a theft case.

The 29-year-old man was allegedly arrested after he refused to give his vehicle to Abhishek Agarwal, I.P.S., Superintendent of Police, District Raebareli.

A bench of Justice Vivek Chaudhary and Justice Narendra Kumar Johari, emphasizing the seriousness of the matter, passed this order on a petition moved by Gomati Mishra (70), who alleged that her son/victim (Alakh Mishra) was arrested by the police on the night of 30/31.3.2024. Still, his arrest was shown a day later in a theft case, i.e., on the night of 31.3.2024/1.4.2024.

In her plea, she claimed that the entire episode was recorded on the CCTV Camera of the Petrol Pump, from which the arrest was made.

She further alleged that her son does not have any criminal record and is falsely implicated in the theft case only because he refused to provide his Taxi to Sri Abhishek Agarwal, I.P.S., Superintendent of Police, District Raebareli when he was asked by some of the subordinate officers of the IPS Officer.

The Court noted that despite repeatedly being granted, to date, opposite party officers could not file any reply as to why no investigation had been conducted by them regarding the alleged arrest dated 30/31.3.2024.

Against this backdrop, the Court passed the following order:

In the given circumstances, we find it a fit case to refer the matter to the Director General of Police, U.P., Lucknow, who shall get a S.I.T. constituted of persons superior to the alleged police officers including Sri Abhishek Agarwal, I.P.S., Superintendent of Police, District Raebareli, to investigate the entire incident.”

The Court has called for a report of the SIT within a period of two months.
