Will Release Man Arrested Over Objectionable Post On Sambhal Violence Today Itself If Bail Bonds Furnished: UP Govt To High Court
The Uttar Pradesh Government informed the Allahabad High Court today that it will release 59-year-old businessman Mohammad Javed, also known as Javed Pump, whom UP Police arrested on Sunday night for allegedly inciting unrest by posting an objectionable post on social media regarding the recent violence in the State's Sambhal district.
Violence erupted in Sambhal district after a team led by an advocate commissioner surveyed the Mughal-era Jama Mosque on the orders of a local court. The violence has resulted in the deaths of four persons.
Javed Pump, who is a former Welfare Party Of India Leader, is already facing a case pertaining to the June 2022 Prayagraj Violence incident wherein he has been accused of causing damage to public property.
The State Counsel stated before a bench of Justice Arvind Singh Sangwan and Justice Mohd. Azhar Husain Idrisi, which was hearing Javed's habeas corpus plea, that he will be released by 5 pm today, provided he furnishes the requisite bail/surety bond today itself before the Assistant Commissioner of Police, Prayagraj.
The bench was also apprised that he was arrested pursuant to a case under Sections 126 (Security for keeping peace in other cases), 135 (Inquiry as to truth of information), and 117 of Bharatiya Nyaya Suraksha Sanhita, 2023. Since he failed to furnish a bail bond along with two sureties to the tune of Rs. 50,000/-, he was sent to judicial custody.
Before the bench, Senior Advocate SFA Naqvi, assisted by Advocate Shashwat Anand, appeared for the petitioner and argued that he was illegally arrested from his house at 10:45 PM on November 24 and was put in illegal detention.
The court will hear his habeas corpus plea on November 29.
Javed was arrested on Sunday night on charges of breaching peace by posting an objectional post on social media. After the alleged post was identified, Javed was arrested, and the post was taken down.
