The Allahabad High Court on Monday directed that no coercive steps be taken against a man (Mohd. Zaki) whose brother (Mohammad Fareed) was allegedly lynched by a mob in Aligarh last month on suspicion of committing dacoity.
Mohammed Farid, alias Aurangzeb, was allegedly assaulted with iron rods over suspicion of committing theft at the house of a cloth trader.
Eleven days after his death, the UP Police booked him, his brother (Mohd. Zaki) and six others had been booked by the UP Police under charges of dacoity and assaulting a woman to outrage her modesty.
Seeking relief in the case and challenging the FIR lodged against him, his deceased brother and six others, petitioner-Zaki moved the High Court wherein his counsel argued that one Laxmi Rani Mittal lodged the FIR in question with a 'malafide' intent in response to the case lodged regarding Aurangzeb's 'mob lynching'.
It may be noted that Mittal's Husband and son Rahul are one of the six persons who have been accused in the alleged Mob Lynching case.
Considering the submissions of the counsel for the petitioner, a bench of Justice Siddhartha Varma and Justice Ram Manohar Narayan Mishra, noting that the matter requires consideration, issued notice to the State of UP and called for a counter while issuing the following order:
“Till next date of listing or till the submission of charge sheet, whichever is earlier, no coercive action shall be taken against the petitioner, subject to their cooperation in the investigation”.
