BHU Student Death Case: Allahabad High Court Seeks Status Of Chargesheet Against 2 UP Police Constables

The Allahabad High Court has asked the Uttar Pradesh government to clarify whether a chargesheet has been filed against the two police constables and one home guard who were allegedly found involved in the death case of a 24-year-old student from the Banaras Hindu University (BHU).

A bench of Chief Justice Arun Bhansali and Justice Vikas Budhwar granted the State Counsel until December 4 to complete instructions as to whether a charge sheet has been presented against the accused pursuant to the grant of sanction.

The case pertains to a student who went missing under mysterious circumstances in 2020, with allegations pointing to the involvement of certain police personnel.

In 2022, the CB-CID found in its probe that a body cremated by local cops in 2020 was that of a BHU student. This submission before the HC had confirmed that the missing student was no longer alive.

In April 2024, the UP Government informed the Allahabad High Court that it had found no sufficient evidence against the then Station House Officer BB Tiwari, Sub Inspectors Kunwar Singh and PM Tripathi, Head Constable Laxmikant Mishra and Constable Om Prakash Singh in the BHU Missing Student case.

The Court was also informed that sufficient evidence had been found against Constables SK Singh and VK Yadav and Home Guard Santosh Kumar for committing an offence under Section 166 IPC, and the Government has also granted a sanction to file a chargesheet against them.

It may be noted that in August 2020, the High Court took cognisance of the matter after Advocate Saurabh Tiwari, an alumnus of the BHU, filed a letter petition regarding the student's disappearance. In November that year, the High Court transferred the investigation to the CB-CID.

As per the facts averred in the letter petition, the student was picked up by certain police personnel from the M.P. Theatre ground, BHU on February 12 and was taken to the Police Station Lanka, District Varanasi. His father made several complaints to senior police officials of Varansai, registered IGRS complaints, etc., but in vain.
