The Madhya Pradesh High Court has held that the data entry charges fixed by the Union government were not applicable on a contract signed by a private firm with a district collector for the work of National Population Register.
The petitioner private firm had signed the contract with the district collector Satna for data entry work of National Population Register for Rs. 4 per family.
The firm claimed it is entitled to Rs. 4 per person on basis of the Union Government’s communication.
A division bench of Chief Justice Hemant Gupta and Justice Vijay Kumar Shukla observed: “Since the agreement specifically provides date entry charges Rs.4/- per family, therefore, we do not prima facie find that the subsequent clarification issued by the Govt. of India would be applicable in respect of the contract entered into between the petitioner and the Collector, Satna.”
The court said: “If the grievance of the petitioner still survives, it is open to the petitioner to agitate its grievance in respect of money claim arising out of the contract.”
The court disposed of the petition.
