In an interim direction, the Madhya Pradesh High Court has directed the medical education authorities to ensure filling up of 50% seats reserved in private medical colleges for students’ domicile of Madhya Pradesh as per provisions of MP Autonomous Medical and Dental Post Graduate Colleges Admission Rules 2017.

The court served notices on the respondents, including the director of medical education and five private colleges, during the hearing of a petition filed by a lady doctor.

The petitioner, a lady doctor, challenged the admission granted by the medical education authorities to certain students contrary to the norms as they are not domicile of Madhya Pradesh.

The petitioner cited the provisions of MP Private Medical and Dental Post Graduate Course Admission Rules 2017, wherein 50% seats in private medical colleges has to be filled up by the state government, according to the provisions of MP Government Autonomous and Medical and Dental Colleges Post Graduate Course (Degree/Diploma) Admission Rules, 2017.

The candidates, whom the admission were given on seats reserved for students domicile of MP, were from outside the state and did not possess a domicile certificate, which is a mandatory eligibility condition prescribed under Rule 6(II) of the MP Autonomous Medical and Dental College Post Graduate Course (Degree/Diploma) Admission Rules, the petitioner took the ground.

A division bench comprising Justice Ravi Shankar Jha and Justice Sushil Kumar Palo directed “the respondent/authorities shall ensure that the 50% seats reserved in Private Medical Colleges for students of M.P. or reserved for M.P. students in private medical colleges shall be filled up by only those students who fulfill the eligibility criteria and qualification regarding domicile prescribed under the provisions of the MP Autonomous Medical and Dental Post Graduate Colleges Admission Rules 2017”.
