The Supreme Court has cancelled the admission of students in a medical college in Madhya Pradesh, as an inspection conducted by the Medical Council of India revealed that the college was deficient.

A bench of Justice SA Bobde and Justice L Nageswara Rao also directed that the students whose admissions have been cancelled shall be accommodated by the state of Madhya Pradesh in such colleges as possible with their merits. The bench also issued notice to the college to showcause why an order to compensate the students for having required them to sit in a deficient college should not be made.

Although the counsel for the college disputed the allegations in the report, the bench observed: “In any case, this Court hereby accepts the inspection since we are not inclined to go into the disputes on facts raised on behalf of the petitioner-college….. we are satisfied that the petitioner-college has failed in the said inspection.”

The MCI inspection had also found that that the college depicted fake patients, who were not patients or merely shown to be lying on the beds, in an attempt to show occupancy.

On this aspect, the bench said: “We find that we are not in a position to determine the truth or otherwise of the allegations. However, if the allegations of the MCI are correct, it is obvious that a serious offence as contemplated by Section 193 of the Indian Penal Code may have been made out.”

The court also directed to constitute a committee headed by a senior officer deputed by the CBI Director and two doctors of the All-India Institute of Medical Sciences (AIIMS) to enquire into these aspects and place the report before it within three months.
