The Delhi High Court has directed the Delhi University to admit 301 students over and above the 2310 students to its three-year LLB course without the cutoff date of August 31 coming in the way in any manner.

“The respondent nos.3 and 4 (DU and Faculty of Law) are directed to ensure that 2,310 candidates are admitted to the LLB course and the supernumerary candidates (301) would be admitted over and above 2,310 candidates.

“It is made clear that in case supernumerary candidates have been admitted as part of the 2,310 candidates, the respondent nos.3 and 4 shall make the appropriate adjustments so as to ensure that 2,310 candidates are admitted and that the supernumerary candidates are adjusted over and above, and beyond this number of 2,310,” a bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar ordered.

It clarified, “Inasmuch as the applicants are before the court and the matters have been pending for consideration before us, the cutoff date of 31st of August, 2017, shall not come in the way of these candidates being permitted to join the LLB course.”

The order of the court came on a petition moved by Joginder Kumar Sukhija against objections by the Bar Council of India to the number of seats to which the students can be admitted to the LLB course of the Faculty of Law of the Delhi University and the varsity erroneously, including the supernumerary seats, as part of the total of 2,310 seats to which admissions have been effected and, thereby, closing the admissions after filling only 2,310 seats.

It said the University of Delhi was required to admit 301 candidates in the reserved categories as supernumeraries over and above 2,310 seats.

It said since the year 2008 till 2015-16, the University of Delhi was admitting 2,310 students as well as additional supernumerary candidates for the PWD/CW/FN categories (persons with disability/children and widows of armed forces/foreign nationals), pursuant to which the court had made an interim order permitting the Law Faculty to admit 2,310 students for the present academic session.

It was also complained by the applicants that the respondent no.3 has not filled up the vacancies as per its past admissions and notifications. The applicant pointed out that as in the year 2016-17, the respondents have this year also erroneously included the supernumerary seats as part of the total of 2,310 seats to which admissions have been effected and, thereby, closed the admissions after filling only 2,310 seats.
