In a major interim relief to students, the Delhi High Court has directed the Central Board of Secondary Education (CBSE) to compulsorily accept all applications of all students for re-evaluation of class 12 answer sheets and re-evaluate them forthwith while holding that grave and irreparable loss and damage would enure so far as their admissions to colleges and universities are concerned.

A bench headed by Acting Chief Justice Gita Mittal also directed the CBSE to not limit the scope of re-evaluation to 10 major subjects.

“CBSE shall conduct re-evaluation of answer sheets of the petitioners as have been applied by them. The respondents (CBSE) shall accept all applications for re-evaluation in all subjects which the petitioners may apply for and conduct the re-evaluation forthwith,” the bench ordered.

The court’s order came on the petition of four students who had challenged CBSE’s June 28 notice limiting the re-evaluation to 10 subjects i.e English Core, English Elective (CBSE), English Elective (NCERT), Hindi Core, Hindi Elective, Mathematics, Physics, Chemistry, Biology, Business Studies, Economics and Accountancy and a maximum of 10 questions.

While granting the relief to the petitioners, the bench said, “it is noteworthy that it is not the present petitioners alone who would be impacted by the result of this writ petition but the relief has to be dispensed to all students who have undertaken the class 12th examination”.

The relief, the high court expressly stated, is “not confined to the petitioners in this writ petition and shall be admissible to all similarly situated students who seek re-evaluation of their answer sheets.

In the meantime, hours after the high court directed the CBSE to compulsorily accept applications for re-evaluation of answer sheets, petitioners’ advocate Sandeep Bajaj told Live Law that CBSE office in Dehradun was still not entertaining applications for re-evaluation and had turned away one student saying they had no knowledge of any such direction.

The matter will now be taken up on July 26.
