The Delhi High Court has put a stop on the appointment and promotion of guest teachers till October 11 at a time when the Delhi government is getting ready to table a Bill for regularization of guest teachers in the Assembly on October 4.

Justice AK Chawla directed the government to maintain a status quo after the government counsel expressed ignorance on whether the Bill would cover those guest teachers who have been working since 2010.

The court was hearing a contempt petition by NGO Social Jurist wherein advocate and social activist Ashok Agarwal raised the issue of delay in appointment of teachers despite the high court order of 2001.

The instant proceedings, which came to be initiated in October 2016, are in relation to the direction given by the division bench of the Delhi High Court for filling up the vacancies of teachers, which at that time was 26,031 and did not include the 9,000 new posts that were created by the AAP government.

The court noted that “an advertisement inviting applications to fill up the post of teachers was issued during the instant contempt proceedings on August 7 but was withdrawn on August 24… Today, a Bill is to be passed by Delhi government for regularisation of such guest teachers possibly which are appointed since 2010. Here it is worth noting that while the orders passed by the division bench of this court in 2001 are yet to be implemented as per the affidavit dated September 16, as for guest teachers, which are said to be getting appointed as a stop gap arrangement, the process for their promotion is continuing…”

On being queried as to whether any such regularisation shall have bearing on the guest teachers who are getting appointed since 2010, the government counsel feigned ignorance but stated that such a Bill will be tabled before the Legislative Assembly on October 4.

This forced the court to put on hold any appointment or promotion of guest teachers till October 11.

The Delhi government had submitted the guest teachers were working against the vacant direct recruitment post and promotional posts. As per the recruitment rules of PGT/ TGT, 75% posts are promotional and 25% are by direct recruitment.  While recruitment and promotions were on for the year 2015-16, the same would be done for 2016-17 once the current process is over.
