Court grants Bail for Under Trial Prisoner to write DU Law Entrance Test

An under trial from Tihar jail has been granted three - day interim bail on an application made before Special CBI Court, Delhi. The order was made on the application by Nirvikar Singh, who wishes to appear for the entrance test of Delhi University, Faculty of law, which is to be held on June 5 to June 7.

Gurdeep Singh, the special judge before whom this application came, while acknowledging the accused’s right to pursue further study, opined that "he cannot be debarred from the opportunity of getting enrolled in law course, if he so wishes". The court while granting bail for the accused from June 5 to June 7, asked him to furnish a personal bond of Rs. 1 Lakh and one surety of the same amount.

The court accepted the submission by Advocate Pramod Kumar Dubey, appearing for Nirvikar Singh, ensuring that there is no ground for the apprehension, that he would interfere with or tamper with the evidence, once enlarged on bail. The plea raised by the CBI prosecutor, K.P. Singh that the applicant may be allowed to appear the exam only in judicial custody, was also turned down by the court.

Nirvikar Singh who is being tried for accepting bribe had been released on bail before on May 22 and 24 for appearing entrance test of Lloyd Law College. This is not the first time courts took such a stand towards accused applying for interim bail on similar grounds. On December 8, 2014, Delhi High Court granted three day parole to S.S. Rathi to submit a thesis for M.A. first year examination and on June 21, 2013, Vinay Sharma, accused of Delhi gang rape was allowed to write his B.A. First Year Exam.
