The Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has recently issued an order to clarify its previous directive dated 26th June 2023 concerning Ansal API Ltd.'s Sushant Golf City High-Tech Township project in Lucknow. This order specifies that there are no restrictions on registering allocations for projects that obtained completion certificates before the implementation of the Real Estate Regulatory Authority (RERA).

UPRERA further clarified that completion certificates were granted for specific projects such as Santushti Enclave 1 (blocks A, B-1, and V-2), Paradise Crystal (blocks A, B, E, and F), and Celebrity Garden (blocks/towers 08, 09, 11, F, G, and H) before the enactment of RERA. Consequently, promoters are authorized to execute registered sale deeds in the names of the allottees for these projects.

Mr. Sanjay Bhushreddi, Chairman of U.P. RERA, emphasized that this clarification aims to safeguard the interests of allottees who have been awaiting possession of their units for an extended period. Regarding ongoing investigations against the promoter, directives have been issued for the submission of supplementary responses along with affidavits. Subsequent decisions will be made in accordance with the provisions of the RERA Act and based on evidence presented after hearing the promoter.

This clarification arose from applications submitted by both the promoter and the allottees of the respective projects, aiming to guarantee prompt possession of apartments or plots to the allottees upon project completion. It was further stated that the onus on the promoter to avert any disputes concerning ownership or possession regarding the land or units of registered allottees. Additionally, U.P. RERA will oversee the management of funds received from allottees in completed projects, ensuring payments are disbursed against recovery certificates issued solely to allottees of the promoter's Hi-Tech Township in Lucknow.

Furthermore, UPRERA reiterated that the remaining provisions of the 26th June 2023 order will remain in effect until the investigation is concluded. Any violation of the RERA Act or the terms of the previous order will result in punitive action.
