The District Consumer Disputes Redressal Commission, Kozhikode (Kerala) bench of P.C. Paulachen (President) and Priya(Member) held MyG Digital, LG Service Centre and LG Electronics India liable for deficiency in services for withholding the Complainant's television which was sent to the service centre for repairs for an unreasonably long time.
Brief Facts:
The Complainant purchased a 32-inch LED LG television from the shop of MyG Digital (“Seller”), paying Rs. 23,490/-. The Seller assured the Complainant that the product carried a warranty of 2 years. Subsequently, the TV malfunctioned and stopped functioning. The Complainant made multiple attempts to notify the Seller about the issue. Eventually, the TV was taken to the LG Service Centre. The problem was identified as a panel complaint, and the TV was promised to be returned within one week after repairs. However, despite more than two weeks passing, the TV was not returned, with the LG Service Centre citing various reasons for the delay. Following a month-long wait, the Complainant sent an email seeking updates but received no response.
Later, the Complainant issued a lawyer's notice to the Seller, LG Service Centre and LG Electronics India Pvt. Ltd, but received no response from either. Feeling aggrieved, the Complainant filed a consumer complaint in the District Consumer Disputes Redressal Commission, Kozhikode, Kerala (“District Commission”) against the Seller, LG Service Centre and LG Electronics India.
The Seller, LG Service Centre and LG Electronics India didn't appear before the District Commission for proceedings.
Observations by the District Commission:
The District Commission held that the conduct of the Seller, LG Service Centre and LG Electronics India in withholding the TV from the Complainant, despite the passage of considerable time, constituted a gross deficiency of service and unfair trade practice. The District Commission held that the Complainant, having been deprived of the intended use of the TV he purchased, suffered significant mental distress and inconvenience due to the actions of the Seller, LG Service Centre and LG Electronics India.
Consequently, the District Commission directed the Seller, LG Service Centre and LG Electronics India to repair the TV belonging to the Complainant and return it in a sound working condition within 30 days. Alternatively, they were directed to refund the purchase price of Rs. 23,490/- to the Complainant after retrieving the TV. They were also directed to pay a compensation of Rs. 10,000/- to the Complainant along with Rs. 3,500/- for the litigation costs incurred by the Complainant.
