Chhattisgarh HC Dismisses Plea For NIA/CBI Probe On Falling Of Dome At PM’s Speech Venue [Read Judgment]

The Chhattisgarh High Court has dismissed with costs a PIL seeking a probe by the Central Bureau of Investigation or National Investigation Agency into the unfortunate incident of falling of the dome which was being prepared for the Prime Minister to address the public.

The public interest litigation was filed by Chhattisgarhi Samaj Party.

Anil Dubey, president of the Chhattisgarhi Samaj Party, had sought for a direction for taking action against the errant official’s actions. “Since it relates to the safety and security of the Hon'ble Prime Minister, this matter may be directed to be investigated by some independent agency like the CBI or NIA,” it was contended.

A bench consisting of Justice Pritinker Diwaker and Justice Sanjay K. Agrawal observed that ‘’in the present case, the matter has already been investigated and the report has been submitted to the State Government, which is pending consideration. The petitioner, which is a political party, seems to have filed this petition only for gaining political mileage, that too after the delay of two years of the alleged incident. The office of the Prime Minister is neither a proper nor a necessary party in this PIL and only to gain political mileage, the office of Prime Minister has been impleaded”.

The court also held that since the petition was being bereft of any substance, it was dismissed as such with cost of Rs. 25, 000, payable to the High Court Legal Aid Committee.
