SC Permits 13-Yr-Old Rape Victim To Abort 32-Week-Old Foetus, The Oldest So Far [Read Order]

Asking “how can such a small girl become a mother”, The Supreme Court today permitted a 13-year-old rape survivor from Mumbai to terminate her 32 week pregnancy.She is a class seven student.

Considering all orders in recent times,this is  the oldest foetus permitted to be terminated by  the Supreme Court. The law does not permit medical termination of pregnancy beyond 20 weeks of pregnancy.

Centre opposed termination of the pregnancy saying it was too advanced and could pose risk to mother's life. But the bench headed by Chief Justice Dipak Misra considered the fact that it was due to sexual abuse and that victim did not want to carry on with it.

SC directed that the girl be admitted to Sir J J Hospital in Mumbai on Thursday for a medical team to carry out MTP on Friday.

In the last hearing, the top court had asked the concerned hospital to examine the minor girl and ascertain the condition and advisability of permitting abortion.

The girl`s mother moved the top court, seeking its permission to terminate the pregnancy of her daughter.

Earlier, on July 28, the top court had rejected a petition, on medical grounds, filed by another 10-year-old rape victim, who sought permission to terminate her 32-week-old pregnancy. The minor girl had recently delivered a child in Chandigarh.
